Demurrage / Detention Policies Subject to review of the specifics fact in an individual case and provide general approach is to grant relief where the billed party demonstrates that there was an actual unavailability of retrieval or return due to terminal closure, equipment malfunction, weather, or some other physical impediment and there is no fault or negligence of customer.
Dispute Time Frame
The billed party shall have thirty (30) calendar days from the invoice issuance date to request mitigation, refund, or waiver of fees from Orison. Orison will attempt to resolve fee mitigation, refund, or waiver requests within thirty (30) calendar days of receiving such a request.
Suggested Documentation in Support of Disputes
1. Basic Information: Please include sufficient information to allow Orison to identify the relevant shipment(s). At minimum, this should include: Invoice Number, BL Number, Container Number
2. Dispute Description: Please identify the basis for the dispute. Examples would include Invalid Free Time, Invalid Rate, Invalid Term, Cargo Availability, Empty Return Restriction, Government Inspections, etc.
3. Evidence: Please include information sufficient to allow Orison to confirm the existence of the circumstance described in response to number 2 that forms the basis for the dispute (including, as applicable, evidence that such circumstance was not the result of an act or omission of the disputing party or its agents or another party for which the disputing party was acting as agent). While Orison will review each dispute individually, and documentation sufficient to support a dispute will vary based on the facts and the claimed basis for the dispute, Orison expects that the following types of evidence will be necessary to support disputes:
Time stamped screenshots evidencing that appointments, if required, were unavailable*
Time stamped screenshots evidencing Container Unavailability, Email Correspondence with Orison’s personnel notifying of the relevant event/circumstance, Reports for Weather Delays, Time stamped screenshots evidencing Rail Reservation Fail, Governmental Hold / Inspection, Interchange Tickets, Pictures (damaged containers), Pickup: A screenshot indicating no appointments were available for each day of the free time period and up to day of pickup. Each daily screenshot must be time stamped and show that, if required, no appointments were available for all shifts.
* Return: A time stamped screenshot of a terminal appointment system indicating an appointment was not available at any of the given return locations applicable as of the time of the screenshot for the date a waiver is being applied for, including all shifts where applicable. The screenshot(s) must be taken the day prior to the requested waiver date and on the waiver date. Such screenshots must be taken between 6:00 a.m.-12:00pm (noon) the day before the waiver date and between 6:00a.m. and 9:00 a.m. on the waiver date, in the time zone of the applicable terminal.
** A screenshot indicating no reservations were available for each day of the receiving window as indicated on the booking confirmation. Each daily screenshot must show no reservations were available for that day.
*** A statement validating the customs hold was not a result of any act or omission of the disputing party or its agents or another party for which the disputing party was acting as agent.
4. Incomplete Documentation: If, based on the documentation provided, Orison is unable to determine whether a dispute is valid, Orison reserves the right to request additional information as may be necessary. Failure to provide such additional requested information may result in a delay in Orison’s ability to respond to the dispute or denial.
General Term
Demurrage
The charge related to the use of the equipment, and compensatory against Terminal land use cost (Storage) for and equipment incentive purpose.
1.The Merchant pays for carrier’s equipment kept beyond the free time offered by Orison for taking delivery of goods in the port, terminal or depot.
2.Free Time: The period of time offered by Orison to the Merchant free of charge, covering demurrage period beyond which additional charges such as, but not limited to demurrage charges, will be due to Orison.
3. Demurrage Time: For import cargo, the demurrage time is the duration elapsed as from when the container enters a facility/depot till gate-out of the full container.
For export cargo, the demurrage time is the duration elapsed as from gate-in of the full container into the assigned terminal or depot till designated vessel berthing.
4.Demurrage invoice is issued to the person for whose account Orison provided ocean transportation or storage of cargo and who contracted with Orison for the ocean transportation or storage of cargo or the shipper or the consignee. For U.S import shipments, Orison’s standard practice to bill the consignee named on the bill of lading.
However, other parties may make arrangements to pay on the billed party’s behalf.

Detention
The charge for detaining Carrier’s equipment outside the port, terminal or depot, beyond the free time for an equipment incentive purpose.
1.Freetime: The period of time offered by the Carrier to the issue party free of charge, covering Detention period beyond which additional charges such as, but not limited to Detention charges, will be due to the Carrier.
2. Detention Time: For import cargo, the detention time is the duration elapsed as from gate-out of the full container till gate-in of the empty container into the assigned terminal or depot.
For export cargo, the detention time is the duration elapsed as from the Pickup of the empty container in terminal or depot till gate-in of the full container in the assigned terminal.
3.Unless otherwise agreed, Detention invoice is issued to the person for whose account Orison provided ocean transportation or storage of cargo and who contracted with Orison for the ocean transportation or storage of cargo or the shipper or the consignee. However, other parties may make arrangements to pay on the billed party’s behalf.

Detention for Canceled Booking
For intermodal equipment, which is released empty and later redelivered empty (i.e. empty to empty) without an intervening shipment.
The Merchant shall pay per-diem charges for each day past free time until the day the Equipment is returned to the designated place or location.
The per-diem Excess Period charges shall be calculated up to the date of return.
